Please read these terms carefully before using the Wowmet platform.
Wowmet is a neutral social infrastructure platform. We provide tools that allow users to post their availability ("Scheduled Intent") and discover the availability of other users in their geographic area. Wowmet does not curate, rank, promote, or recommend specific users to other users. All discovery is based on proximity and user-defined filters only.
Wowmet is expressly not a matchmaking service. We do not use algorithms to suggest compatibility, romantic potential, or any other subjective matching criteria between users. We make no representations about the suitability of any user you may encounter through the platform. Any connections formed through the Service are entirely at the discretion of the users involved.
All "Scheduled Intent" posts (availability broadcasts) are subject to the following rules:
You must be at least 18 years of age to create an account or use the Wowmet Service. By registering, you represent and warrant that you are 18 or older. Wowmet strictly prohibits access by minors.
In jurisdictions where applicable law (including but not limited to the US Children's Online Privacy Protection Act [COPPA] and India's Digital Personal Data Protection Act [DPDPA]) requires Verifiable Parental Consent for users under the age of 18, Wowmet does not permit such users to access the Service under any circumstances. We do not knowingly collect personal data from individuals under 18. If we become aware that a user is under 18, their account will be immediately terminated and all associated data deleted in accordance with applicable law.
Each user may maintain only one active Wowmet account. Creating multiple accounts is a violation of these Terms and may result in permanent suspension of all accounts associated with you. Users who have been permanently banned may not create new accounts.
The Service may not be available in all geographic locations. You are responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction.
You may not use the Service to post, distribute, or display:
Wowmet uses automated AI-powered moderation tools to review content posted on the platform, including profile images, availability descriptions, and in-app messages. These tools help identify violations of our Community Guidelines and these Terms. By using the Service, you consent to your content being reviewed by automated systems.
If your content is removed or your account is restricted as a result of automated moderation, you have the right to appeal to a human review team. Appeals may be submitted via the in-app appeal function or by emailing Contact@digitalfosters.com. We aim to review all appeals within 5 business days.
Meeting strangers in person always carries inherent risk. By using the Wowmet Service to arrange real-world meetups, you acknowledge and accept that Wowmet is not responsible for the conduct of any user you meet through the platform. You agree to take all reasonable precautions when meeting other users, including meeting in public locations and informing a trusted person of your plans.
Users are required to conduct initial meetups in publicly accessible locations. While we cannot enforce this requirement, repeated reports of users requesting meetups in private locations may result in account review, restrictions, or termination.
To the maximum extent permitted by applicable law, Digital Fosters Inc., its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of profits, data loss, or emotional distress arising from your use of the Service or any meetup facilitated through the platform.
You agree to defend, indemnify, and hold harmless Digital Fosters Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your Scheduled Intent posts, any content you submit, and any meetups you participate in.
Wowmet may offer paid subscription plans ("Premium") that provide additional features. By subscribing, you authorize us to charge the applicable subscription fee to your designated payment method on a recurring basis (monthly or annually, as selected).
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price at the start of each new billing period. We will notify you of any price changes at least 30 days before they take effect.
You may cancel your subscription at any time through the app settings or your app store account. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period except where required by law.
If you are a resident of Ontario, Canada, you have the right to cancel your subscription agreement within one year if we did not provide you with a copy of the agreement, or within 30 days if we provided the agreement but you did not use the service during that period, in accordance with the Consumer Protection Act, 2002 (Ontario).
If you are a consumer in the European Union or United Kingdom, you have the right to withdraw from a subscription purchase within 14 days of the date of the transaction (the "cooling-off period") without giving any reason, in accordance with the EU Consumer Rights Directive and UK Consumer Contracts Regulations. However, by expressly requesting that we begin providing the Service immediately, you acknowledge that your right of withdrawal may be forfeited once service delivery has commenced.
The Wowmet name, logo, app design, code, text, graphics, and all other content created by Digital Fosters Inc. are owned by or licensed to Digital Fosters Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our proprietary content without prior written permission.
By posting content (including profile photos, availability descriptions, and messages) on the Wowmet platform, you grant Digital Fosters Inc. a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, display, and distribute such content solely for the purpose of operating and improving the Service. You retain all ownership rights in your content. This license terminates when you delete your content or your account.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in Ontario, Canada for any disputes not subject to arbitration.
Except for claims that may be brought in small claims court, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be finally resolved by binding arbitration administered by the ADR Institute of Canada in accordance with its rules. The arbitration shall take place in Toronto, Ontario, and shall be conducted in English. The arbitrator's decision shall be final and binding.
YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF ANY CLASS OR REPRESENTATIVE PROCEEDING. You waive your right to participate in a class action lawsuit or class-wide arbitration against Digital Fosters Inc. or any of its affiliates.
Any claim arising from the use of the Service must be filed within one (1) year after the cause of action arose. Claims filed after this period are permanently barred.
We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
We may suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and Community Safety Guidelines, constitute the entire agreement between you and Digital Fosters Inc. regarding the Service.
